Acceptance of Terms

By accessing, browsing, or using Pic of Today, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our platform.

Description of Service

Pic of Today is a community-driven image sharing platform where users can upload image and vote for images posted by others. The community elects winning images on a daily, monthly, and yearly basis through a voting system. Our platform is designed to showcase creative content from our community while maintaining a safe and legal environment.

Eligibility

You must be at least 13 years old to use Pic of Today. By using our platform, you represent and warrant that you meet this age requirement. Users under 18 should have parental or guardian permission before using our service.

User Accounts and Sessions

Pic of Today operates using anonymous sessions. When you visit our platform, a session is automatically created for you without requiring registration. This session allows you to post images and vote. Each session is limited to posting a limited amount of image per day and voting once per image. Attempts to circumvent these limitations through multiple sessions or technical manipulation are strictly prohibited and may result in permanent bans.

Content Ownership and License Grant

This section is critical and defines your rights and obligations regarding uploaded content.

Your Content: You retain ownership of any images you upload to Pic of Today. However, by uploading an image to our platform, you grant Pic of Today a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, distribute, and display your image in any media formats and through any media channels. This license is necessary for us to operate the platform, display your image to other users, feature winning images, and promote our service.

No Deletion: By uploading an image to Pic of Today, you acknowledge and agree that your image becomes a permanent part of our public community gallery and cannot be deleted or removed except in cases where the content violates our Community Guidelines or applicable law. This permanence is essential to maintaining the integrity of our daily, monthly, and yearly contests. Once an image receives votes and participates in our contests, removing it would unfairly impact the voting records and contest results.

Your Warranties: By uploading an image, you represent and warrant that you own all rights to the image or have obtained all necessary permissions and licenses to grant us the rights described above. You warrant that your image does not infringe any third-party copyrights, trademarks, privacy rights, publicity rights, or any other intellectual property or proprietary rights. You are solely responsible for ensuring you have the legal right to upload and share any image you post.

Prohibited Personal Data: You agree not to upload images that contain your own identifiable personal data, including but not limited to clear photographs of your own face, identification documents, personal contact information, or any other data that could be used to directly identify you. This restriction is necessary to comply with data protection regulations. Images containing identifiable information of other individuals are subject to the restrictions in our Community Guidelines, and you are responsible for obtaining necessary permissions before posting such content.

Community Guidelines and Prohibited Content

You must comply with our Community Guidelines at all times. Prohibited content includes but is not limited to pornography, sexually explicit content, gore, graphic violence, hate speech, discriminatory content, illegal activities, content promoting self-harm, copyrighted material you do not own or have permission to use, personal information of others, spam, unsolicited advertising, and any form of child exploitation.

All uploaded images are automatically scanned using content moderation technology before publication. Images that violate our guidelines will be automatically rejected or removed by our moderation team. Repeated violations may result in permanent bans from the platform without prior warning.

Voting System

Each session may vote once per image. The voting system determines daily, monthly, and yearly winning images based on community votes. Any attempt to manipulate the voting system through automated tools, multiple sessions, or other fraudulent means is strictly prohibited and will result in immediate and permanent ban from the platform.

Intellectual Property

The Pic of Today platform, including its design, features, functionality, code, and all content not uploaded by users, is owned by Pic of Today and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our platform or its underlying code without our express written permission.

Content Moderation

We reserve the right to remove any content that violates these Terms of Service or our Community Guidelines, even if it passed automated moderation. We also reserve the right to remove content if required by law or if we believe in good faith that such action is necessary to comply with legal obligations, protect our rights, ensure user safety, or maintain platform integrity.

Disclaimer of Warranties

Pic of Today is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, secure, or error-free. We do not warrant the accuracy, reliability, or completeness of any content on the platform. You use the service at your own risk.

Limitation of Liability

To the maximum extent permitted by law, Pic of Today and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your access to or use of or inability to access or use the platform. Our total liability for any claims related to the platform shall not exceed the amount you paid us to use the platform in the past twelve months, which in most cases will be zero as our platform is free to use.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Pic of Today regarding your use of the platform and supersede any prior agreements.
